Pending payment

Some time ago, my father started a legal case which resulted in a settlement agreement requiring the other part to make monthly payments over a number of years. The case was a disappointment as we found that our own lawyer had raised our expectations but failed to follow through in safeguarding our interests, leading to a much lower outcome than expected. A few months ago the defendant started skipping payments. I emailed their lawyer and that helped solve the issue, however ever since there have been repeated delays. The February bank transfer carried the description that it would be the final one as per the agreement, which is incorrect - one more installment is due to settle the amount. In early March I contacted again their lawyer notifying the mistake... and made a few readings.

  • Before the March due date: what about the payment? 26.0 – being retained
  • What to do to recover it? 54.1 > 40 – taking a soft approach leading to release
  • How about sending another email to the debtor’s attorney? 50.2 > 56 – not entirely sure about the meaning, but took it as a good omen
  • No response or progress after the email: state of payment? 27.6 > 24 – not promising
  • Calling the debtor’s attorney? 52.0 – no
  • Involving our own lawyer? 18.6 > 46 – will not provide the needed support
  • How to recover the money? 49.5 > 55 transforming as a tiger? I’m lost!
The amount is not very high but it’s still our right to collect it. After the first delay we could have demanded that the entire pending amount be paid but did not, so having to put up with the other part’s trickery would be particularly infuriating. Thank you in advance for any insight.

I imagine it all comes down to this...

How to recover the money? 49.5 > 55 transforming as a tiger? I’m lost!

What natural revolution is this that imposes itself as the right moment to let go of what belongs to the past and start a new phase? A phase of gathering abundant evidences to make the right decision, which will lead you to a better situation than the current one? ...

....is there the possibility of, through the court, without further direct or indirect costs, fully enforcing the agreement that was made in that court?...seizing all of his assets to guarantee full payment of the debt?

...is there "something completely outside the box" that predisposes the other party to comply with its obligation?

...if none of this...then forget it!...embrace the "new present", without the weight of that past!

Thanks for your insight, @breakmov. The only option coming to mind is to contact the conciliation body who formally supported the settlement to request counsel on how to solve the matter. I’m not even sure to be able to find the original documentation, going back a few years.

What about my interpretation of the other castings? I thought 40 as relating hex was quite encouraging. Would you agree that neither attorney seems to be the solution? Any other thoughts on 49.5? Thanks again for any help.

54.1 -- 40

..you are placed in a situation where you have no space for your own aspirations, all that remains is for you to adapt to the circumstances.

It seems to me that the entire description you left about the situation shows that the person in question is not going to pay, so...

.if there is certainty (?) that there is no mistake and there is really still a payment left and the other person does not pay...

- Is there a way to guarantee the missing payment without additional costs?

...if yes, then activate these means

...if not....forget and accept the loss...move on and let go of that situation.

Ok, I see now that 40 may refer to releasing the situation as a whole.

Are there other insights?

Yes.

....the confirmation of very old advice on the use of Yijing :

- Make sure that all direct options to solve a question are used... in a situation like this you don't need to ask the yijing.

If that advice were followed Shared Readings would be a deserted forum… It’s the other way round. Yi helps getting clarity on situations and determining the best course of action.

The bank transfer arrived on Thursday, when I was no longer expecting it. Relating 40 ultimately did not disappoint
:spinning:
The last few castings indicated no need to do anything, not even consult the oracle (49.5).
